Welcome to SeniorMail! These Terms of Service ("Terms") govern your access to and use of our email services. By using our services, you agree to be bound by these Terms. If you do not agree to these Terms, please do not use our services.

1. Service Description

SeniorMail provides email services designed for senior citizens, including email accounts, webmail access, and related features. Our services are available to individuals who subscribe to one of our plans and agree to these Terms.

2. Account Registration and Eligibility

To use our services, you must:

• Be at least 18 years of age
• Complete the registration process by providing accurate and complete information
• Update your account information promptly if any changes occur
• Maintain the security and confidentiality of your account password
• Accept responsibility for all activities that occur under your account

3. Payment Terms

Our services are available on a subscription basis with various plans as described on our website. By subscribing to our services:

• You agree to pay all fees associated with your selected plan
• Subscriptions are billed annually in advance
• Payments are non-refundable except as required by law or expressly stated in these Terms
• We may change our fees upon notice, and continued use of the services after such notice constitutes acceptance of the new fees
• Failure to pay fees may result in suspension or termination of your account

4. Acceptable Use Policy

When using our services, you agree not to:

5. Email Content and Storage

SeniorMail provides specific storage limits based on your subscription plan. You are responsible for managing your email storage and ensuring it remains within your plan's limits. We recommend regularly deleting unnecessary emails to maintain optimal service performance.

While we respect your privacy, you acknowledge that:

• We may scan email content for spam, viruses, and other security threats
• We may access, preserve, and disclose your account information and content if required by law or to protect our rights, property, or safety
• Email is not guaranteed to be secure or error-free, despite our best efforts

6. Service Availability and Modifications

While we strive to provide continuous and reliable service, we do not guarantee that our services will be available at all times. We may occasionally experience technical difficulties or need to perform maintenance that could temporarily affect service availability.

We reserve the right to modify, suspend, or discontinue any part of our services at any time, with or without notice. We will make reasonable efforts to notify you of significant changes that may affect your use of our services.

7. Travel and Access Restrictions

If you are traveling, please note that access to our service from within countries identified as high spam and hacker risk is restricted to protect our servers and our clients. Please call us if you are traveling and would like to verify if the country you plan to visit is considered high-risk.

8. Account Termination

You may terminate your account at any time by contacting our customer support. We may terminate or suspend your account if:

• You violate these Terms
• You fail to pay applicable fees
• We believe your actions may create liability for us or other users
• We cease providing the services

Upon termination:

• Your access to the services will end
• We may delete all data associated with your account
• We are not liable for any loss or damage resulting from account termination or data deletion

9. Intellectual Property

Our services, including all content, features, and functionality, are owned by SeniorMail and its licensors and are protected by South African and international copyright, trademark, patent, and other intellectual property laws.

You may not:

• Copy, modify, distribute, or create derivative works based on our services
• Remove any copyright, trademark, or other proprietary notices from our services
• Use our trademarks, service marks, or logos without our prior written consent

10. Disclaimer of Warranties

Our services are provided "as is" and "as available" without warranties of any kind, either express or implied, including, but not limited to, implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

We do not warrant that our services will be uninterrupted, error-free, or free from harmful components, or that any defects will be corrected. You use our services at your own risk.

11. Limitation of Liability

To the maximum extent permitted by applicable law, SeniorMail and its affiliates, officers, employees, agents, and partners will not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, use, or goodwill, arising out of or in connection with your use of or inability to use our services.

In no event will our aggregate liability exceed the amount you paid for the services in the 12 months preceding the claim.

12. Indemnification

You agree to indemnify, defend, and hold harmless SeniorMail, its affiliates, officers, employees, agents, and partners from and against any claims, liabilities, damages, judgments, awards, losses, costs, expenses, or fees (including reasonable attorneys' fees) arising out of or relating to your violation of these Terms or your use of our services.

13. Governing Law and Dispute Resolution

These Terms are governed by and construed in accordance with the laws of South Africa, without regard to its conflict of law principles. Any disputes arising from or relating to these Terms or our services shall be subject to the exclusive jurisdiction of the courts of South Africa.

14. Changes to Terms

We may modify these Terms at any time by posting the revised terms on our website. Your continued use of our services after the effective date of the revised Terms constitutes your acceptance of the changes. It is your responsibility to review these Terms periodically.

15. Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision will be limited or eliminated to the minimum extent necessary, and the remaining provisions will continue in full force and effect.

16. Entire Agreement

These Terms constitute the entire agreement between you and SeniorMail regarding your use of our services and supersede all prior and contemporaneous agreements, proposals, or representations, whether written or oral.
